Aditya Gupta advises and represents companies on a broad range on commercial laws with significant experience in intellectual property litigation and technology law, including on issues arising out of emerging tech such as NFTs and AI.

Aditya has been actively involved in some of India’s most high-profile commercial litigation including before the Supreme Court in relation to keyword advertising and the patentability of Novartis’ product Glivec, and before the High Court of Delhi in cases involving complex questions on the interplay between NFTs, gaming and the scope of celebrity rights, non-conventional trademarks, certification trademarks, on the ‘right to be forgotten’, e-commerce intermediary liability disputes and litigation against patent trolls.

His clients include Google, L&T Valves, Reddit, Mobile Premier League (MPL), InterGlobe (Indigo Airlines), Mensa Brands, the Ministry of Electronics and Information Technology and Justdial.

Representative Matters
  • Successfully represented Google in trademark litigation relating to keyword advertising in proceedings before the Supreme Court and the High Court of Delhi.
  • Representing Google in litigation relating to restrictions under the General Data Protection Regulations regarding transfer of personal data to Indian Courts.
  • Representing Google in litigation in the Indian Supreme Court relating to online defamatory content, anonymity of users and assistance to law enforcement agencies.
  • Successfully represented the All India Gaming Federation in litigation relating to celebrity rights and NFTs available on online gaming platforms.
  • Successfully represented, as first chair, one of India’s largest electric cycles’ manufacturers in litigation related to non-conventional trademarks (numeral trademarks).
  • Successfully represented, as first chair, GS1 India, the Indian affiliate of the global standards agency on barcodes, in landmark litigation on certification trademarks in barcodes.
  • In a previous role, represented Novartis in the landmark litigation before the Indian Supreme Court relating to India’s patentability standards for pharmaceuticals.
  • Advising and representing Mensa Brands, India’s largest house of digital brands, on acquisition, protection and enforcement of brands.
