Kruttika Vijay is an experienced litigator who focuses on intellectual property litigation, civil and commercial dispute resolution, and intellectual property advisory and prosecution. She regularly appears in various courts across India and has also had the privilege of appearing before the Supreme Court of India as first chair.

Kruttika is currently also a panel counsel for the Government of the National Capital Territory of Delhi in the District Courts, Delhi.

Her clients include TATA SIA Airlines (Vistara), Infiniti Retail (CROMA), Innoterra AG and its group companies, The Himalaya Wellness Company, the Dayal Group, Roppen Transportation (Rapido), Inbrew Beverages and former Indian women’s cricket captain, Ms. Mithali Raj.

Representative Matters
  • Represented InsightsIAS, as first chair, before the Supreme Court in a landmark case which laid down the applicable legal standard for admissibility of documents in commercial litigation in India.
  • Representing Hosting Concepts before the High Court of Delhi in batch matters clarifying the role of domain name registrars in trademark litigation and disclosure of registrant data.
  • Successfully defended Vistara before the High Court of Delhi against allegations of trademark infringement and passing off by demonstrating non-trademark use, non- distinctiveness and descriptiveness of the plaintiff’s registered trademark.
  • Represented Vistara before the High Court of Delhi in a writ which clarified the role of the Trade Marks Registry in determining a mark as well known under the scheme of Indian trademark law.
  • Representing Hosting Concepts before the High Court of Delhi in batch matters clarifying the role and obligations of domain name registrars in trademark litigation.
  • Successfully represented a Gujarat-based paper mill, as first chair, before the Competition Commission of India against allegations of cartelization without a monetary penalty being imposed.
  • Advising statutory authorities on the scope of protection of key geographical indications and litigation strategy.
  • In a previous role, represented F. Hoffmann La Roche before the High Court of Delhi in the first contentious pharmaceutical product patent litigation in India which went to trial.
  • In a previous role, represented Enercon in intellectual property litigation with its estranged Indian joint venture partner.
  • In a previous role, represented Dr. Aloys Wobben, a noted inventor, before the High Court of Delhi on questions of maintainability of multiple invalidation actions against a single patent.
